서비스 이용약관

본 서비스 이용약관(이하 "약관")은 HourShine(이하 "당사")이 제공하는 교육 멘토링 및 컨설팅 서비스의 이용과 관련하여 이용자와 당사 간의 권리와 의무를 규정합니다.

서비스를 등록, 예약, 결제 또는 이용함으로써 이용자는 본 약관, 개인정보처리방침 및 해당 프로그램에 적용되는 프로그램 운영정책(Program Policies) 에 동의한 것으로 간주됩니다. 프로그램 운영정책은 본 약관의 일부를 구성하며, 본 약관과 동일한 효력을 가집니다.

1. 서비스의 내용

HourShine는 다음과 같은 교육 멘토링 및 컨설팅 서비스를 제공합니다.

• Research & Projects

• Writing

• Debate & Harkness

• Admissions Strategy

• Academic Strategy

서비스는 프로그램별 안내에 따라 1:1 또는 그룹 형태로 제공될 수 있으며, 모든 서비스는 교육적 자문 및 멘토링을 목적으로 합니다.

2. 프로그램 운영정책

일부 프로그램에는 별도의 프로그램 운영정책(Program Policies) 이 적용됩니다.

운영정책에는 다음과 같은 사항이 포함될 수 있습니다.

• 출결

• 일정 운영

• Make-up 수업

• 그룹 운영 방식

• 공휴일

• 준비물

• 과제

• 기타 프로그램별 운영 사항

해당 프로그램에 적용되는 프로그램 운영정책은 본 약관에 편입되어 본 약관의 일부를 구성하며, 이용자는 프로그램 등록, 예약, 결제 또는 이용 시 이를 함께 확인하고 동의한 것으로 간주됩니다.

3. 이용 대상

서비스는 학생 및 학부모(또는 법정대리인)를 대상으로 합니다.

만 18세 미만 학생은 보호자의 동의 하에 서비스를 이용해야 합니다.

미성년 학생의 프로그램 참여와 관련하여 당사는 출결, 일정, 학습 진행 상황, 과제, 안전 또는 행정 사항 등 교육 운영에 필요한 정보를 보호자 또는 법정대리인과 공유할 수 있습니다. 보다 구체적인 사항은 해당 프로그램 운영정책에 따릅니다.

4. 등록 및 결제

모든 서비스는 별도 합의가 없는 한 선결제를 원칙으로 합니다.

요금은 프로그램, 기간 및 범위에 따라 달라질 수 있습니다.

결제가 완료되지 않은 경우 서비스 제공이 제한되거나 중단될 수 있습니다.

5. 취소 및 환불

취소, 환불 및 계약 종료는 본 약관, 해당 프로그램 운영정책 및 관계 법령에 따라 처리됩니다.

이미 제공된 서비스에 대해서는 환불이 제한될 수 있습니다.

패키지 상품의 경우 이용한 서비스는 단일 세션 기준으로 재산정될 수 있습니다.

본 약관은 관계 법령상 이용자에게 인정되는 권리를 제한하지 않습니다.

6. 결과에 대한 보장 없음

HourShine는 다음 사항을 보장하지 않습니다.

• 특정 학교 또는 대학 합격

• 장학금

• 수상

• 출판

• 연구 성과

• 시험 성적

• 기타 학업 또는 진로 결과

모든 결과는 학생의 노력 및 외부 평가 기준 등 다양한 요인에 따라 달라질 수 있습니다.

7. Academic Integrity

HourShine는 멘토링, 피드백 및 교육적 지도를 제공합니다.

학생은 제출하는 모든 과제, 연구, 지원서 및 기타 결과물의 내용, 정확성, 독창성 및 최종 제출에 대한 책임을 집니다.

학생은 학교, 기관 또는 대회에서 정한 AI 및 Academic Integrity 정책을 준수해야 합니다.

8. 지적재산권

학생이 작성한 원본 결과물의 저작권은 학생에게 귀속됩니다.

HourShine가 제공하는 커리큘럼, 수업 자료, Framework, Methodology 및 기타 교육 콘텐츠의 지적재산권은 HourShine에 있습니다.

학생은 HourShine의 사전 서면 동의 없이 이를 복제, 배포 또는 상업적으로 이용할 수 없습니다.

9. 비밀 유지

당사는 이용자의 개인정보 및 상담 내용을 존중합니다.

이용자는 당사의 자료, 수업 내용 및 독자적인 교육 자료를 무단으로 녹화, 배포 또는 공유해서는 안 됩니다.

10. 이용자의 의무

이용자는 다음 사항을 준수해야 합니다.

• 예의 있는 커뮤니케이션

• 정확한 정보 제공

• 프로그램 목적에 맞는 이용

학생 및 보호자는 학교, 대학, 시험 및 대회의 일정과 제출 기한을 직접 확인하고 관리할 책임이 있습니다.

11. 책임의 제한

관계 법령이 허용하는 범위 내에서 HourShine는 간접적, 특별 또는 결과적 손해에 대해 책임을 부담하지 않습니다.

당사의 책임은 관련 서비스에 대해 이용자가 실제 지급한 금액을 초과하지 않습니다.

12. 외부 서비스

HourShine는 다음과 같은 제3자 서비스를 사용할 수 있습니다.

• Zoom

• Stripe

• Calendly

• Google Workspace

제3자 서비스의 장애 또는 문제에 대하여 당사가 직접 통제할 수 없는 범위에서는 책임을 부담하지 않습니다.

13. 서비스 중단 및 해지

다음의 경우 서비스 제공을 중단 또는 종료할 수 있습니다.

• 결제 의무 불이행

• 약관 위반

• 프로그램 운영이 현저히 어려운 경우

• 부적절하거나 반복적인 방해 행위

필요한 경우 HourShine는 다른 멘토 또는 일정을 제안할 수 있습니다.

14. 불가항력

천재지변, 정부 조치, 전쟁, 전염병, 통신 장애, 인터넷 장애 및 기타 당사가 합리적으로 통제할 수 없는 사유로 인해 서비스 제공이 어려운 경우, 당사는 합리적인 범위 내에서 일정을 조정하거나 대체 서비스를 제공할 수 있습니다.

15. 약관의 변경

당사는 필요에 따라 본 약관을 변경할 수 있습니다.

중대한 변경이 있는 경우 웹사이트 또는 기타 적절한 방법으로 사전에 안내합니다.

16. 준거법

본 약관은 HourShine가 서비스를 운영하는 국가의 관련 법령에 따라 해석 및 적용됩니다.

These Terms of Service ("Terms") govern your access to and use of educational consulting and mentorship services provided by HourShine ("HourShine," "we," "us," or "our").

By registering for, purchasing, scheduling, or using our services, you agree to these Terms, our Privacy Policy, and any applicable Program Policies. The applicable Program Policies are incorporated into and form part of these Terms and have the same legal effect as these Terms.

1. Scope of Services

HourShine provides educational consulting and mentorship services, including but not limited to:

• Research & Projects

• Writing

• Debate & Harkness

• Admissions Strategy

• Academic Strategy

Services may be provided individually or in groups depending on the program. All services are educational in nature and are provided as mentorship and consulting, not as legal, financial, psychological, or licensed educational services unless expressly stated otherwise.

2. Program Policies

Certain HourShine programs are subject to additional Program Policies.

Program Policies may include, among other things:

• attendance requirements

• scheduling

• cancellations

• make-up sessions

• holidays

• course materials

• homework expectations

• program-specific operating procedures

Applicable Program Policies form part of these Terms and apply in addition to these Terms.

3. Eligibility

Our services are intended for students and, where applicable, their parents or legal guardians.

Students under the age of eighteen (18) must participate with the consent of a parent or legal guardian.

For students under the age of eighteen (18), HourShine may communicate with a parent or legal guardian regarding attendance, scheduling, academic progress, assignments, safety, administrative matters, and other information reasonably necessary for the operation of the program. Additional details are set forth in the applicable Program Policies.

4. Enrollment and Payment

Unless otherwise agreed in writing:

• Payment is required before services begin.

• Pricing varies by program, duration, and scope.

• Failure to complete payment may result in suspension or termination of services.

5. Cancellation and Refunds

Cancellation, refunds, and termination of services are governed by these Terms, the applicable Program Policies, and mandatory applicable law.

Refund eligibility, where applicable, shall be determined in accordance with those policies and any applicable legal requirements.

Nothing in these Terms limits any rights that cannot legally be excluded or waived.

6. No Guarantee of Outcomes

HourShine does not guarantee any particular outcome, including but not limited to:

• admission to any school, college, or university;

• scholarships or financial aid;

• competition results;

• publications;

• research outcomes;

• grades or standardized test scores; or

• any academic, professional, or personal achievement.

Educational outcomes depend upon numerous factors beyond HourShine's control, including the student's own effort and decisions.

7. Academic Integrity

HourShine provides mentorship, instruction, strategy, and feedback.

Students remain solely responsible for:

• the originality of their work;

• the accuracy of information they submit;

• compliance with school, university, competition, and institutional policies; and

• the final submission of all applications, assignments, essays, research, and other materials.

HourShine does not complete graded assignments or misrepresent authorship on behalf of students.

Students are responsible for complying with any policies governing the use of artificial intelligence or other third-party tools.

8. Intellectual Property

Students retain ownership of their original work.

All curricula, educational materials, frameworks, methodologies, lesson plans, templates, graphics, and other proprietary content created or provided by HourShine remain the intellectual property of HourShine unless otherwise stated.

Such materials may not be copied, reproduced, distributed, or commercially used without prior written permission.

9. Confidentiality

HourShine respects the confidentiality of its clients.

Clients agree not to record, reproduce, distribute, or publicly share proprietary educational materials or session content without prior written permission.

Nothing in this section limits disclosures required by law or reasonably necessary to protect the safety or legal rights of any person.

10. Client Responsibilities

Clients agree to:

• provide accurate and complete information;

• communicate respectfully with mentors and staff;

• participate in services in good faith; and

• independently monitor and meet all school, university, scholarship, competition, testing, and application deadlines.

Unless otherwise expressly agreed in writing, HourShine is not responsible for submitting applications or other materials on behalf of clients.

11. Limitation of Liability

To the fullest extent permitted by applicable law, HourShine shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

Where liability cannot legally be excluded, HourShine's total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Third-Party Services

HourShine may use third-party services including, but not limited to:

• Zoom

• Stripe

• Calendly

• Google Workspace

We are not responsible for interruptions, outages, or other issues arising solely from third-party platforms beyond our reasonable control.

13. Suspension or Termination

HourShine reserves the right to suspend or terminate services where:

• payment obligations are not fulfilled;

• these Terms or applicable Program Policies are violated;

• continued participation materially disrupts the learning environment; or

• continued engagement is otherwise reasonably determined to be inappropriate.

Where appropriate, HourShine may offer an alternative mentor, schedule, or other reasonable accommodation.

14. Force Majeure

HourShine shall not be responsible for delays or interruptions caused by events beyond its reasonable control, including but not limited to natural disasters, government actions, war, epidemics, internet outages, platform failures, or other force majeure events.

Where reasonably possible, affected services will be rescheduled or otherwise accommodated.

15. Changes to These Terms

HourShine may update these Terms from time to time.

Material changes will be communicated through our website or other appropriate means before taking effect where reasonably practicable.

Continued use of our services following the effective date of updated Terms constitutes acceptance of the revised Terms, except where additional consent is required by applicable law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which HourShine operates.
